Terms of Use
1. Acceptance of these Terms
These Terms of Use ("Terms") form a binding agreement between you ("you", "User") and QARACloud ("we", "us", the "Service"), operated by BHP Consulting LLC, 1207 Delaware Ave # 1939, Wilmington, Delaware, United States. By accessing, registering for, or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.
2. Purpose of the Service — informational only
The Service provides a searchable interface over publicly available FDA data, which may include, without limitation: 510(k) premarket notifications, Establishment Registration & Device Listing, Product Classification (product codes and regulation numbers), the Global Unique Device Identification Database (GUDID), and sections of Title 21 of the U.S. Code of Federal Regulations (21 CFR). The information is provided for general informational and reference purposes only.
3. Your duty to verify (no reliance)
Data is obtained from third-party (FDA) sources and processed automatically. It may differ from the current official records due to source errors, update timing, import or display issues. You are solely responsible for independently verifying and confirming any information directly with the official FDA sources before relying on or acting upon it. You must not treat the Service as an authoritative, official, or complete record.
4. No professional advice
Nothing on the Service constitutes legal, regulatory, medical, clinical, or other professional advice, and no professional relationship is created. Seek qualified professional counsel for your specific situation.
5. No affiliation with the FDA or any government agency
QARACloud is an independent service. It is not affiliated with, endorsed, sponsored, or approved by the FDA or any government body. "FDA" and related names are the property of their respective owners and are used only to describe the source of public data.
6. Accounts and security
Some features require an account. You agree to provide accurate registration information, to keep your credentials confidential, and to be responsible for all activity under your account. Notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms.
7. Acceptable use
You agree not to: (a) use the Service for any unlawful purpose; (b) attempt to gain unauthorized access, disrupt, or compromise the security or integrity of the Service; (c) scrape, harvest, or extract data through automated means beyond normal interactive use, or in a way that imposes an unreasonable load; (d) misrepresent the data as official FDA records; or (e) resell or redistribute the Service in a way that competes with it without authorization.
8. Intellectual property
The underlying FDA data is public information. The Service's software, interface, design, and compilation are protected by applicable intellectual-property laws and remain the property of QARACloud or its licensors (including third-party components such as the grid library used under its own license). You receive a limited, revocable, non-exclusive right to use the Service for its intended purpose.
9. Third-party links and components
The Service links to external FDA pages and documents (such as 510(k) Summary PDFs) and loads certain interface components from third-party providers. We do not control and are not responsible for the content, availability, or policies of third-party sites or components.
10. Disclaimer of warranties
THE SERVICE AND ALL DATA ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF ACCURACY, COMPLETENESS, TIMELINESS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DATA MATCHES OFFICIAL FDA RECORDS.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, QARACLOUD AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE OR YOUR RELIANCE ON ANY DATA, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID (IF ANY) FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
12. Indemnification
You agree to indemnify and hold harmless QARACloud and its operators from any claims, damages, or expenses arising out of your use of the Service, your reliance on the data, or your breach of these Terms.
13. Changes to the Service and Terms
We may modify, suspend, or discontinue the Service, and may update these Terms, at any time. Material changes will be reflected by updating the "Effective date". Your continued use after changes constitutes acceptance.
14. Termination
We may suspend or terminate your access at any time for any reason, including violation of these Terms. Sections that by their nature should survive (disclaimers, limitation of liability, indemnification) will survive termination.
15. Governing law and jurisdiction
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws rules. Any dispute shall be submitted to the state or federal courts located in the State of Delaware, unless mandatory law provides otherwise.
